2020 riots: No bail for co-accused in ‘larger conspiracy’

New Delhi: A Delhi court on Thursday denied bail to Tasleem Ahmed, an accused in the larger conspiracy related to 2020 Delhi riots.The court of additional sessions judge Sameer Bajpai said that a predecessor bench had opined that there were reasonable grounds for believing that the accusations against him were prima-facie true."Surprisingly, the said order of the learned predecessor bench has not been challenged by the applicant and this court now cannot review its own order and give any contrary opinion," the judge said.The case against Tasleem Ahmed was registered under Indian Penal Code sections and the Unlawful Activities (Prevention) Act, 1967.Apart from Tasleem Ahmed, 19 are accused in the case. Among them are Tahir Hussain, Umar Khalid, Khalid Saifı, Ishrat Jahan, Meeran Haider, Gulfisha Fatima, Shifa-Ur-Rehman, Asif Iqbal Tanha, Shadab Ahmed, Saleem Malik, Mohd. Saleem Khan, Athar Khan, Safoora Zargar, Sharjeel Imam, Faizan Khan and Natasha Narwal.This is the second time the court has denied regular bail to Tasleem Ahmed. "It is to be noted that in the case in hand the bail application of the applicant was dismissed... vide order dated 16.03.2022, in which he has already concluded that on the perusal of the chargesheet and accompanied documents, for the limited purpose of the bail, in his opinion the allegations against the accused, Tasleem Ahmed, were prima-facie true," the court said.Ahmed’s counsel said the plea was moved as co-accused Devangana Kalita, Narwal and Tanha were given regular bail. But the court said the high court had given an opinion specifically about the other co-accused persons, which did not apply to Tasleem Ahmed.
