HC stays order on re-determination of pay scale for promoted asst teachers
Dehradun: Uttarakhand high court stayed the Dec 18, 2025, order concerning re-determination of pay scale for promoted LT grade assistant teachers serving in govt inter-colleges. The court asked the state govt to file its response by the next hearing on April 27.The matter was heard by the vacation bench of Justice Alok Mehra on Wednesday. Petitioners, including Sevak Singh, Gopal Datt Pant, Pramod Kumar, Dharam Ram Arya and Pyare Lal Sah, challenged the Govt Servants Pay Rules (First Amendment) 2025 and finance secretary's Dec 18 order on the re-determination of pay scale for promoted teachers.

Petitioners argued that under the Govt Servants Pay Rules 2016, lecturers and LT Grade assistant teachers were entitled to one increment when granted a promoted pay scale. However, state govt amended the rules through the 2025 amendment, with retrospective effect from Jan 1, 2016, abolishing the increment at the time of promotion. The finance secretary's Dec 18 order implemented the re-determination based on the amended rules.
Representing the petitioners, their advocate contended that the amendment targeted only employees of the education cadre. He further argued that state govt could not abolish the increment payable under the 2016 pay rules with retrospective effect.
