Ensure RERA norms are not flouted in deals: HC

Cuttack: The Orissa high court has called for preventing land deals without registering with Odisha Real Estate Regulatory Authority (ORERA).The observation was made on Wednesday on a PIL seeking the court’s direction to the authorities for implementation of the Real Estate (Regulation & Development) Act, 2016 in respect of land deals under plotted schemes.The petition, filed by Pratap Kumar Rout, sought intervention against landowners creating sub-plots from large patches of land without registering the bigger plot with ORERA and selling them to multiple buyers. Plots larger than 500 square metres have to be registered with ORERA. Strict implementation of Section 3 of RERA will pave the way for bringing transparency in land deals and subdue the domination of brokers, it was contended.While disposing of the PIL, the two-judge bench of Chief Justice Chakradhari Sharan Singh and Justice Sangam Kumar Sahoo said, “On the basis of the pleadings in the petition, the court is not inclined to issue a general direction to the authorities to follow the statutory requirements of the RERA.”“The court, however, observes that the concerned authority shall make sincere endeavour to ensure that the provisions of Section 3 of RERA are not violated,” the bench said.In a counter affidavit, ORERA claimed steps have been taken to ensure sub-registrars abide by the statutory requirements for registration of properties covered by the provisions of RERA/ORERA.

Rera will monitor builder-buyer deals now

UP-Rera released guidelines to monitor mutual settlements between homebuyers and developers, ensuring adherence to norms and preventing denial of settlements. The guidelines require execution on non-judicial stamp paper, verification through web portal or physical verification/email, and emphasize non-denial once executed.

The Visakhapatnam Metropolitan Region Development Authority (VMRDA) is set to auction bulk land parcels and vacant plots in Visakhapatnam and Vizianagaram districts. The auctions will gauge market sentiment and influence real estate prices in neighbouring areas. Upcoming auctions will take place in March with upset prices ranging from 20,000 to 67,500 per square yard.
