HC bins plea for rehab as family not ‘fully displaced’

Cuttack: Orissa high court has held that the state govt is justified in rejecting entitlements under relevant resettlement and rehabilitation policies to affected families as such denial hinges on the degree of displacement.The ruling was given recently while considering the case of Balaram Behera, whose plea seeking benefits as per the Odisha Resettlement and Rehabilitation Policy, 2006, was rejected by the Angul collector on Jan 10. Behera had received compensation for his land acquired for the establishment of industry in Angul district in 2000.The two-judge bench of Justices S K Sahoo and Chittaranjan Dash on Aug 8 said, “Given the factual findings and the procedural context, the collector’s order is both justified and consistent with the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and the Odisha Resettlement and Rehabilitation Policy, 2006.”The 2013 Act and 2006 policy have clearly drawn distinction between a project displaced family (PDF) and project affected family (PAF), the bench said. A PDF has been wholly displaced from their original homestead land, while a PAF retains some land or property and has not been entirely displaced. While dismissing the petition, the bench said, “The petitioner’s ability to construct and maintain buildings on the remaining unacquired land supports the classification as a PAF, not a PDF.”
