CUTTACK: The Orissa high
court
on Monday refused to modify an order that directed the collector of Balangir and tehsildar of
Titilagarh
to pay from their pockets for travelling expenses to appear in person before it.
The court was hearing the case of Om Prakash Kumbhar, who is presently a senior revenue assistant at the
tehsil office
at Khaprakhol in Balangir district. He was previously posted at the tehsil office at Titilagarh.
On March 8, the single judge bench of Justice Biswanath Rath had directed both the officers to personally appear infront of the court.
The direction was issued after the court took strong exception for depriving Kumbhar from getting his actual salary for the past two years on the ground of non-receipt of last pay certificate (LPC) from his previous place of posting.
In pursuance of the order, Balangir district collector Chanchal Rana and Titilagarh tehsildar Karna Mallik appeared in person in court on Monday.
An affidavit submitted before the court said, “The defect that appeared in the LPC has been subsequently rectified and now the revised LPC has been sent to Khaprakhol tehsil office. In such view of the matter, it is respectfully submitted that the grievance of the petitioner no more subsist.”
Both the officers also sought modification of the March 8 order on bearing travelling expenses from their own pockets.
