Armed Forces Tribunal

. "He served the Army with distinction during WWII and deserves to be treated with honour at the fag end of his life," AFT said.

Ex-gunner Govinda Raju had joined Army in October 1942 (during Linlithgow's viceroyship) when he was 18. He was inducted in the

Royal Indian Artillery unit

where he served for five years, earning several medals and decorations. Despite being fit, Raju was discharged from service by an order in June 1947 seeking a reduction in Army personnel. Despite several representations, he was not provided pension benefits following which Raju moved the tribunal.

In its reply, the Army said according to rules, Raju's service documents were destroyed 25 years from his discharge. Pension regulations say a minimum qualifying service period to receiving pension was 15 years. As he had rendered around four years and seven months of service, Raju was not eligible. Raju's counsel said after his stint in the Army, he was employed in the railways and now received pension. But Raju was discharged from service because of the decision to reduce personnel, so he was entitled to special pension.

A bench of judicial member Justice S S Satheesachandran and administrative member Lt Gen K Surendra Nath said according to Army's pension regulations, 1940 for viceroy's commissioned officers and other ranks, five years of service was required for special or service pension. Though Raju was not entitled for pension, he could receive special gratuity. But with records destroyed, the Army could not specify that Raju be provided the benefit.

Also, Raju could not be provided war veterans life time assistance of 6,000 by the state government as he was already receiving pension from the railways. So he could be given the financial assistance from the government/Army headquarters' welfare funds. "This will go a long way in ameliorating the financial situation of the war veteran," the bench said.

Rightly could be squashed under " to err is human " All could be waived for the mighty and the influenced. While a young lad of 14..8 years in the tender age being a son of an E.S.M.(ex-serviceman, recipient of Long Service and Good Conduct Medal), who was building up is career was thrown out like a fish out of water, having been made medically unfit for hyper-idrosis - palms, Idiopathic soles, by a Govt. of India Ministry of Defence, constituted Army Medical Board. in 1966, thrown out like a fish out of water. No consideration paid, since not influential or mighty politician.Served during the dark days of the nation(chinese aggression 1962 and Pak War 1965. During his original discharge, the document recorder made wrong entry as Army Rule 13(4) which is discharged on own request * Resultant, the Office of the PCDA (Pension), Allahabad, U.P., obviously not granted Army Medical Disability Pension and the Army Major Bhusan, so swollen headed, with ego and arrogance, not prepared to correct the document and claim PPO for self (* Now a research scholar in PhD in Law).to restore my rights and privileges. Depriving me and continue to elongate the period of deprival as now self around 70 years. At 68, self alone travelled from Chennai to Jabalpur and returned and had a bad experience, and was constrained to ask Major Bhusan, a general service officer despite from the ranks elevated. as to how he deals with senior citizens obviously shows how he treats and care his own father, .emotionally said and returned back to Chennai. If god do really exists he would be punished carrying the curses of soldiers like me.WHERE IS FAIRNESS AND JUSTICE AFTER 69 LONG YEARS OF INDIAN INDEPENDENCE.
