As far as blood found on

car is concerned, it was not of the deceased,

Akash Sen

. On the basis of evidence, the defence concluded that the entire case has been “fabricated” and accused Harmehtab has to do nothing with Sen’s death.

Sen, a relative of former

Himachal Pradesh

chief minister Virbhadra Singh, was allegedly run over by a BMW car following a brawl in sector 9 on February 9, 2017. The prosecution had stated that accused Balraj Singh Randhawa had crushed Sen under his car after being instigated by another accused Harmehtab Singh Rarewala. While Rarewala was arrested on February 16, 2017, Randhawa remains at large.

Advocate NPS Waraich, defence counsel of Harmehtab, stated that the alleged car is not involved in the accident. Narinder Singh was the first person who spotted the car in Gobindgarh but he didn’t see any dent or blood, then forensic team visited gobindgarh and they also did not see any dent, another forensic team in Chandigarh examined the car and they also did not mention any dent. Even in Challan there is no mention of any dent.

He further argued that it was four months after the alleged crime on June 1, 2017 that ASI Vijay Kumar mechanically examined the car on the orders of Poonam Dilawari and he said that there is a scratch on BMW. But when asked how old the scratches were, Vijay Kumar could not define age of scratch and said he could not say if those were two days, eight days or 10 months old scars. Waraich said that there was not even a scratch on the BMW car, and those were later planted by the investigating agency to strengthen their case.
