Chandigarh: INLD leader and Ellenabad MLA Abhay Singh Chautala on Wednesday filed a petition before the Punjab and
Haryana high court seeking quashing of the order passed by Haryana assembly speaker Gian Chand Gupta suspending him from the House for two days.
In his plea, Chautala has contended that the speaker did not follow the procedure of bringing a motion on the suspension of a member of the House and did not act in accordance with the Rules of Procedures and Conduct of Business in the Haryana Legislative Assembly as a motion to suspend the petitioner was not brought in the House. He also alleged that the action of the speaker in this matter was malafide, unconstitutional, unjust and unfair.
“As per Rule 104-A and 104-B, the speaker cannot pass the order of suspension for more than the remainder of the day of the session and cannot pass the same without bringing the motion on the floor of the House,” Abhay highlighted in his plea.
Advocate Sandeep Goyat, counsel for Chautala, said the petition would come up for hearing on Thursday. The petitioner has sought directions to set aside the speaker’s order dated February 21 suspending Abhay Singh Chautala for two days.
“The copy of the impugned action will be published after the completion of the session, which is scheduled at the end of March, but the announcement regarding passing of the order of suspension for two days has been made on February 21 on the floor of the House. The news regarding the suspension was published in the newspapers on Wednesday,” the petitioner has added.
