Sub-registrar not liable for later fraud: HC
Bhopal/Jabalpur: The MP high court has said that an official from the registrar office, who registers the sale of a property based on relevant papers produced before him, can't be prosecuted if a fraud is later detected in the deal.With this observation, the court quashed the order of the trial court in a case whereit had asked the policeto also prosecutethe sub-registrar, who had done the registry of the land allegedly sold fraudulently by two persons to the complainant in the case.The bench of Justice BP Sharma, while quashing the order on the petition of the sub-registrarconcerned, said that such an order is not legally tenablesince a sub-registrar can't refuse to register a property if relevant papers are produced for the purpose and all the other formalitieshave been completed.
