HC to govt: Proceed with recruitment process of teachers
Bhopal/Jabalpur: A division bench of the MP high court allowed the state govt to proceed with the recruitment process of high school teachers, which began in 2023. However, HC ordered that the appointments of candidates under the exam would be subject to the final decision of the court.During the hearing of the petition on Tuesday, the court also expressed "unhappiness" over the retrospective implementation of EWS reservation in the 2018 eligibility exam for the recruitment of teachers. The case will now come up for hearing on Nov 12.MP govt had organised an eligibility test for the recruitment of high school teachers in 2018. In 2019, rules for EWS reservation were formed and implemented for this exam with retrospective effect. The minimum qualifying marks for general candidates were initially 60, but after the provision of EWS reservation was put in effect, they were reduced to 50. Some appointments were made based on the exam, but many vacancies remained unfulfilled. Meanwhile, the state govt started a fresh recruitment process for teachers in 2023. The 2023 recruitment process was challenged in the high court by candidates belonging to EWS category. A single-judge bench of the MP high court has then directed the govt to fill all vacancies from 2018, before proceeding with the fresh recruitment process.The state govt filed a revision petition against the order of the single-judge bench before a division bench of the high court. The division bench allowed the govt to continue with the recruitment process for the vacancies, which were advertised in 2023, stating that the appointments would be subject to the final order of the court in the case.During the hearing of the petition on Tuesday, the court was informed that the state govt had stalled the 2023 recruitment process, as the court had orally stayed the recruitment process during the last hearing, the govt said. Some respondents informed the court that EWS reservation was given in the 2018 recruitment process with retrospective effect. The court, expressing surprise at this, conveyed "unhappiness" with the govt's decision to provide EWS reservation with retrospective effect.
