HC junks habeas corpus plea of woman about ‘missing’ hubby
Bhopal/Jabalpur: A division bench of MP high court disposed of a habeas corpus petition filed by a woman about her missing husband after the police in compliance to an earlier court order in the case produced the missing husband of the woman with liberty to wife and husband to approach an appropriate forum to resolve their differences or take recourse to legal remedy for the purpose.

The petition filed by Babita, a resident of Adhartaal locality in Jabalpur, said that her husband Shankarlal had gone on duty on February 4, 2023, but didn't return. A missing person complaint was lodged at Adhartaal police station.
Subsequently, her husband's mobile phone got switched off. Police and family of her husband in Satna were informed about the same but there was no action on the part of the police to find her husband, therefore she was compelled to file a habeas corpus petition seeking court's intervention in tracing her husband.
The court had directed Adhartaal police to produce the missing husband of the petitioner in court. The police produced Shankarlal before the vacation bench of Justice Vivek Agrawal and Justice P N Singh following which the court disposed of the petition since the relief sought in it was provided.
The court however, gave liberty to the woman and her husband to go to an appropriate forum to resolve their differences or take recourse to legal remedy for the purpose. Advocate Mridul Vishwakarma appeared in the case on behalf of the petitioner.
