BHOPAL/JABALPUR: A division bench of MP high court dismissed a bail plea moved by a person from Bihar who was arrested in connection with a habeas corpus petition filed by the father of a minor girl after the court issued an arrest warrant against him. Bihar Police had arrested him from his hometown Bhojpur and produced in HC on transit remand.

The accused was sent to jail by the district court. He moved an application for bail, but the division bench of Chief Justice Ravi Malimath and Justice Vishal Mishra dismissed the application and asked him to move an application in the district court, according to procedure.

The father of a 17-year-old girl, in his habeas corpus petition, had said that Pawan Tiwari, a resident of Bhojpur in Bihar, had abducted his daughter and kept her hostage. The girl was missing since January and police had failed to trace him. The court, while hearing the petition, had directed police to produce the girl in court.

She appeared in court and said she had gone to Delhi on January 6 and was staying at the home of a friend. On learning about the petition, she decided to return home, she said.

On behalf of the state government, the court was apprised that a case of abduction under IPC 363 has been registered against Pawan but police have not been able to trace him.

The court then issued an arrest warrant against Tiwari asking for its compliance through the DIG of the area. Bihar police brought him to high court under transit remand given by the court of CJM, Bhojpur. He was then remanded in jail.

Tiwari’s bail plea came up for consideration during the hearing of the habeas corpus petition. The court him to move a regular bail application before a competent court. Advocate Suyash Thakur appeared on behalf of the state government.
