Wrong allotment: BDA told to take action

BANGALORE: A division bench headed by the Chief Justice on Monday directed BDA to take action against the officers responsible for grant of alternative site to Walter B Roche of OMBR Layout in total violation of BDA site allotment rules.
"You have to take action against such officers,'' the bench observed and then directed BDA to place the action taken report within six months before the court.It dismissed BDA's writ appeal challenging the single bench order. The single bench had quashed the cancellation of site allotment order passed by BDA on June 8, 2009 saying BDA cannot punish others for its own wrong doing.
BDA had cancelled the allotment on the ground that it violated section 11 A (iii) of BDA allotment of site rules. However, Walter had contended that he had purchased the site through a valid sale deed from the original allottee in 2005 and had sold the same to one Nandu in 2006. The site was originally allotted to Munikrishna in HBR II Stage layout. An alternative site was allotted in view of the legal wrangle involving the lands.
