Tax commissioner faces CBI probe

BANGALORE: Justices M.F. Saldanha and N.K. Patil of the Karnataka High Court have directed the court's registrar-general to file a criminal complaint with the CBI against M.D. Jain, Joint Commissioner of Sales Tax and Venkatachalam and Lokesh, both staff members of the Family Court of Bangalore. The court has sought investigation into their alleged tampering of court records.

the judges were hearing a contempt of court complaint against the three accused and the fact that they had removed a document from the case file in which m.d. jain was a party, and substituted the same with another document. the judges took serious view of the fact that the hc''s administrative wing hadn''t taken any action in this regard, though they were aware of it eight months back. the court referred to the manner in which the police had acted in another such case, and observed that it would be futile referring the case to the state police for investigation. the judges wanted the cbi to file a report on the next day of hearing, nature of investigation and the action taken. ``if they are dissatisfied with the cbi''s quality and pace of investigation, the consequences shall be grave,'''' the judges said. `re-examine cod findings'': justice r. gururajan asked the corps of detectives director general to re-examine the cod''s findings in the alleged murder of dr shivakumar. dr shivakumar married prabhavathi on may 28, 2000. she''s the daughter of r. rachaiah, a police inspector (traffic) attached to devaraja station in mysore. prabhavathi tried to consume poison because the marriage was reportedly imposed on her by her parents. following the false message that prabhavathi died in hospital, dr shivakumar tried to commit suicide by slitting his neck. he was taken to a hospital. later, however, it came to light that prabhavathi was alive and recovering in the hospital, the petitioner said. by that time, rachaiah and his supporters abducted dr shivakumar''s family members and forced them to sign on some land documents. dr shivakumar too was dragged out of hospital and taken to an unknown place, the petition alleged. his body was found near a railway track in mysore two days after he was found missing from the hospital. shivakumar''s father, nanjiah petitioned the court seeking a cbi probe. the high court then, in an interim order, asked cod to probe the matter. but two inconsistent reports were filed by cod, prompting a re-examination.
