BENGALURU: Pointing out that there are no victims or cheating complaints lodged, the high court quashed proceedings against four people accused of running a fake call centre in Whitefield.

"Mere seizure of mobile phones from the centre during a police raid on July 8, 2022 by itself cannot constitute any offence against the petitioners," Justice K Natarajan observed.

Allowing the petitions filed by Rishi Vyas, Jatiya Kishan Heerabhai, Syed Ibrath and Rishabh, the judge noted that Ethical Infotech Pvt Ltd, the main company, was not named in the two cases registered by Mahadevapura and Whitefield police. The judge said while accused no. 1 Rishi Vyas is an employee of the company, Syed Ibrath is a travel agent and Rishabh is a stranger. Only one director (Jatiya Kishan) has been named as accused in the case.

"There are no victims or any cheating complaint registered against these petitioners. That apart, police in their chargesheet haven't produced any evidence to show the petitioners are involved in running the fake call centre and collected money illegally from customers in India and US," the judge said.

The court said police are free to investigate the matter further and file an additional chargesheet against the actual culprit.

The cases were registered on July 8, 2022 following a police raid. They were filed by officers of Mahadevapura and Whitefield police stations accusing the suspects of running a fake call centre called Ethical Infotech Pvt. Ltd. at Gayatri Techpark Building, EPIP Zone, Whitefield and also at Silver Soft Techpark, Mahadevapura.

According to police, the accused would call Indian and US customers, asking them to collect their 'gifts' from an online marketplace. When the customers would visit the website, they would have to type a password/OTP. Once they did that, the accused company would allegedly withdraw the amount from the customers' accounts.
