BENGALURU: The Karnataka high court on Tuesday granted interim stay - limited to Karnataka - against the Union govt's March 12, 2024, notification banning certain breeds of dogs considered ferocious and dangerous.

Justice M Nagaprasanna of the high court passed the order after hearing a petition filed by King Solomon David and Mardona Jones, both from Bengaluru. The judge ordered notices to the state and central governments and Kennel Club of India, Chennai.

The judge said, "The Delhi HC had clearly indicated all stakeholders - not a few or various - shall be consulted. Kennel Club of India is one (such stakeholder) not consulted is the (petitioner's) submission..." tnn

Ban sought on pitbull terrier, bandogs, mastiffs & more
Therefore, till the deputy solicitor general of India would produce those documents that went into the decision-making of the circular on the strength of the records, the circular dated March 12 issued by the central govt shall remain stayed only in Karnataka." Next hearing is on April 5.

The breeds marked for ban are pitbull terrier, Tosa inu, American Staffordshire terrier, fila Brasileiro, dogo Argentino, American bulldog, boerboel, Kangal, Central Asian shepherd dog (Ovcharka), Caucasian shepherd dog (Ovcharka), South Russian shepherd dog (Ovcharka), tornjak, sarplaninac, Japanese tosa and akita, mastiffs (boerbulls), rottweiler, terriers, Rhodesian ridgeback, wolf dogs, canario, akbash, Moscow guard dog, cane corso and every dog of the type commonly known as a bandog. The circular also advises against further breeding of these dogs kept as pets by owners.

The petitioner's counsel argued that Kennel Club of India, which has various chapters all over the country, has not been heard. He said that to identify a particular breed of dog to be ferocious and dangerous to human life would require profound expertise. "Several breeds are identical to the breeds found in India, which are not the part of the circular," he added.

The deputy solicitor general of India, H Shanthi Bhushan, submitted the circular has been issued on the strength of the Delhi HC's order.
