ALLAHABAD: The Allahabad high court has again asked principal secretary home RM Srivastava and state DGP AC Sharma to extend the consequential benefits to the applicant (constable Ravindra Kumar Saini) or else they may appear in the court on May 2. Though both the officers had appeared in the high court and had complied with its order passed on December 20, 2011, by granting "out of turn" promotion to the applicant.
However, the applicant alleged that he has yet not been extended the consequential benefits as per the court's order.
Justice DP Singh passed this order on a contempt petition filed by the constable, who had alleged that order passed in his favour by the high court has yet not been complied by both the officers in letter and spirit. The applicant's counsel Mamta Singh had contended that the petitioner has been given "out of turn" promotion but other consequential benefits have not been given to him. Therefore, the counsel's demand was that the order has not been complied with, in letter and spirit.
The petitioner was denied "out of turn" promotion by the DIG, and the high court in the petitioner's writ had set aside the DIG's rejection order by directing the principal secretary home and DGP to give "out of turn" promotion to the petitioner with consequential benefits like others for his bravery.
