AHMEDABAD: Just when the dust had settled on the Sohrabuddin fake encounter case, city crime branch received yet another setback when Ahmedabad's metropolitan court ordered re-investigation into the encounter of Samir Khan Pathan.Metropolitan Magistrate TV Joshi ordered Ahmedabad police commissioner on Wednesday to institute a re-investigation by an IPS officer.
The officer will have to submit the inquiry report within 90 days.
The Police Commissioner has been asked to keep the court informed about the progress in re-investigation on a regular basis. The IPS officer appointed by commissioner has been directed to record the statements of all people who had carried out the sting operation, which was published in Tehelka magazine and seize the original CD's of the operation.Joshi also directed the investigating officer to record the statements of police officers, who brought Shahid Khan, an eyewitness to the killing of Samir Khan from Rajkot, as well as Samir's parents. Recently, Shahid had spilled the beans regarding the encounter saying that police had actually killed Pathan. He had also testified that police had taken him along with Pathan and threatened that he would meet with the same fate.On July 13 this year, Samir Khan's cousin Shahista Khan had filed a plea seeking re-investigation into the case by a Central agency. Shahista Khan's advocate I M Munshi, however expressed dissatisfaction at the judgment and said, "We will be filling an application in High court seeking CBI inquiry of the case." City crime branch had gunned down Samir Khan on October 22, 2002, saying that he was Lashkar-e-Toiba operative who was on a mission to kill Modi.
