AHMEDABAD: While acquitting former minister Maya Kodnani, the court cited 13 witnesses who named her and noted that she was implicated for the first time before the Supreme Court-appointed SIT only as a conspirator and instigator, and none of these witnesses named her when they deposed before the police earlier.

The SIT did not come up with any explanation for the delay of over six years. When the investigator was examining these witnesses who accused her of conspiracy, it was incumbent on him to verify those statements and get supportive evidence. But there was no evidence of her involvement in the events of February 28, 2002, except her name in the printed complaints.

Kodnani's acquittal was recorded by the Gujarat high court in the Naroda Patia case after her claim, that she was not present in the area, was established.

There was no probe into the call details showing her location at different places, which she had been claiming since the beginning. The prosecution could not prove her role in criminal conspiracy, unlawful assembly and furthering common intention to cause death and rioting, the court said. tnn
