AHMEDABAD: First, a clarification. This is no Bihar or UP where any politician has to have a criminal record for any claim to fame.
But then politicians in Gujarat, especially those who are in fray for the 26 Lok Sabha seats, haven’t had a very clean record either.
The EC’s guidelines say that if a person is convicted of any offence and sentenced to an imprisonment of two years or more, he/she cannot contest.
Even if the person is on bail during the pendency of an appeal, he/she can’t enter the fray.
The Congress’s candidate from Kapadvanj, Shankersinh Vaghela, has admitted in his affidavit that there are FIRs filed against him at Ahmedabad-Rural and Gandhinagar police stations for offences under sections 13(1)(d) and 13(d) of the Prevention of Corruption Act. The probe into the cases is pending.
Rajendrasinh Patel, who is contesting from Godhra on a Congress ticket, has four cases against him for insulting a person with intent to breach peace, obstructing a public servant from duty, rioting and wrongful restraint.
Congress’s big gun from Vadodara, Satyajit Gaekwad, has been booked on two occasions for holding an unlawful assembly, stealing 20 cans of edible oil and destroying property during a protest against hike in edible oil prices.
Junagadh candidate Jasubhai Barad (Cong) has also been charged with various offences, including attempt to murder. In Valsad, both BJP and Congress candidates face some charges. Kishanbhai Patel of the Congress has been booked twice for stealing forest wood, holding unlawful assembly, endangering the life of a person and insulting a person with intent to breach peace. BJP’s Manibhai Chaudhari has attracted charges of dacoity, trespassing and assault. Bharatiya Navshakti Party’s Nareshbhai Delkar from Valsad, is also accused of rioting and trespassing. BJP’s Ahmedabad candidate and Union minister of state for home, Harin Pathak’s affidavit has a full page devoted to the proceedings relating to the 1985 riots case, including the murder of a constable.
While a lower court ordered framing of charges against him, he has filed an appeal in the Gujarat HC where the matter is pending. The BJP candidate from Surendranagar, Somabhai Patel, has been booked for breach of trust. Another BJP candidate, Nitin Patel from Mehsana, has three cases — including unlawful assembly and possessing fake currency — against him.
Independent candidate from Kutch, Dhanraj Sheda, has been booked for singing obscene songs in a public place, house break-in and criminal intimidation. An Independent from Jamnagar, Kasam Bhokal has devoted twoand-a-half pages of his affidavit to his criminal record. He has been booked for attempt to murder. He was arrested in Gandhinagar and chargesheeted, but evidence is yet to be produced against him.
Surprisingly, the JD(U) candidate from Bharuch, Chotubhai Vasava, who has several offences registered against him, has not mentioned a single case in his affidavit. Of late, he has been accused of harbouring a murder accused. His plea for anticipatory bail was rejected by a Surat court on Friday.
