–Astresia passed away on Monday at Ahmedabad civil hospital. Rudra was being looked after by his grandparents

Rudra’s grandfather Dahyabhai Patel said little Rudra had undergone first operation when he was just two days old. “His mother Toral left us as he found that Rudra had born with Esphagel –Astresia. Since then he was with us. Rudra’s father had lodged a complaint against his mother Toral Patel for deserting the child. Toral is now living at her parental house with her four year old daughter” added Dahyabhai Patel.

Patel said on Monday afternoon, they had to rush Rudra to civil hospital as his condition worsened. “However the doctors at the civil hospital declared him dead after a short treatment. We have lost an angel” said Dahyabhai.

Meanwhile on Monday stayed police from taking any coercive action against Toral Patel from Sabarkantha district on a complaint filed by her husband that she deserted one-year old ailing son, who was hospitalized then.

The high court has asked Toral and her husband Ghanshyam Patel to remain present during further proceeding on the petition filed by Toral for quashing the FIR filed against her by the husband. Till then,

has asked police not to arrest her.

Toral and Ghanshyam Patel’s case hit headlines last month after the husband filed an FIR with

police against her for leaving their one-year old son Rudra, who was born with Esophageal Atresia. She was accused of refusal to return to matrimonial home after giving birth to the boy. Police booked her under the Juvenile Justice (Care and Protection of Children) Act for willfully ignoring the son’s needs and endangering his survival.

In her petition which was filed through advocate Manan Shah, Toral stated that her husband filed the FIR as a counterblast to the complaint she had filed against him and in-laws. Ten days before the FIR was filed against her, her husband and in-laws were booked for cruelty and dowry demand. She claimed that she was not allowed to live in the matrimonial house and complained of harassment.
