Defence lawyer who got notice in murder case granted bail

Agartala: In an unusual occurrence, the West Tripura sessions judge on Saturday granted anticipatory bail to the defence lawyer of accused persons of the shootout case of a BJP leader, Durga Prasanna Deb, in the Shalbagan area of the city on April 30.The defence lawyer, senior advocate Samrat Kar Bhowmik, was served a notice after police failed to arrest the murderers even after a fortnight of the killing of Deb. He was the secretary of an influential club and accused of several crimes.The investigation team has not yet made any significant headway in the case. However, Pradyot Dhar Chowdhury, Sushmita Sarkar and her mother Uma Sarkar, Sandip Kar, Sunny Saha, and Birchakra Ghosh, the younger brother of another prime accused Prabakar Ghosh were arrested out of mere suspicion, and police were not even able to seize the weapon used in the crime. The case took a new turn a week ago when investigating officer Prajit Malakar served a notice to Kar Bhowmik, the lawyer of Birchakra Ghosh, Sunny Saha and Sandip Kar under Section 91 of CrPC referring to a claim of Sunny in police custody that the hard disk of the CCTV of the prime accused Raju Barman’s house was with the lawyer. “I was surprised by the police action of serving a notice to the defence lawyer based on a so-called statement of an accused in police remand, which doesn’t have any evidence value in the court of law. Even if it is with the custody of the accused or his counsel, it’s considered as evidence of defence not evidence of offence and police can’t serve notice to a senior advocate in such a case,” Kar Bhowmik argued.
