NEW DELHI: DLF has approached the Competition Appellate Tribunal (Compat) seeking stay against fair trade watchdog Competition Commission’s order levying a Rs 630 crore penalty for abusing its dominant position.
“Yes, we have moved Compat . The matter has been posted for hearing on November 9,” DLF senior executive director Sriram Khattar said but refused to disclose further details.
Sources said DLF has questioned the Competition Commission of India’s order on various counts beginning with the regulator’s jurisdiction . DLF has argued that the jurisdiction should be that of consumer court.
It has questioned the CCI's jurisdiction to look into flatbuyers’ complaints, pointing out that the matter relates to ‘sale of immovable property’ and not ‘sale of service’ .
